Confusion has rocked the Nairobi County Assembly after Speaker Kennedy Ng’ondi dismissed the reported resignation of Githurai MCA Deonysias Mwangi Waithira.
On Friday, September 19, Speaker Ng’ondi announced that the resignation was “null and void” because the letter that surfaced earlier in the week was not properly signed.
According to him, the Assembly could not act on a resignation that had not followed the correct procedure.
The MCA later admitted he had indeed prepared the document but explained that it leaked before he could deliver it formally.
“It is true I have resigned as Githurai MCA. Unfortunately, the letter I intended for the Speaker leaked online before reaching him. I have tried to meet him to confirm my resignation, but I haven’t been successful,” Mwangi told reporters.
Despite the setback, Mwangi insisted that his decision to leave office stands.
He accused the Nairobi County Executive of frustrating development projects in his ward and ignoring basic service delivery. He claimed his repeated calls for action in the Assembly and committees had been met with silence.
Mwangi, who was elected on a United Democratic Alliance (UDA) ticket, said the neglect of Githurai residents pushed him to quit, adding that he had lost faith in the county’s leadership.
Under Article 194(1)(d) of the Constitution of Kenya, an MCA who wishes to resign must submit a signed letter directly to the Speaker.
Once accepted, the Speaker is required to notify the Independent Electoral and Boundaries Commission (IEBC), which must organize a by-election within 90 days—unless the vacancy falls within three months of a General Election.
