The High Court has issued a significant directive concerning the burial of former Prime Minister Raila Odinga, declining to issue a Conservatory Order that sought to stop the planned ceremony.
This ruling comes shortly after a case was lodged challenging the constitutionality and regularity of burying the national leader within 72 hours of his death.
The petitioner, identified as Luo elder Michael Onyango Otieno, had lodged the case arguing that the swift burial plans were irregular and unconstitutional.
Crucially, Otieno contended that the express wishes of the late Raila Odinga himself were not being respected and upheld by those organizing the funeral.
However, as confirmed by Citizen TV senior journalist Seth Olale, the High Court has refused the application to halt the proceedings.
In a tweet from his official account, Olale shared that the court "Declines to issue Conservatory Order stopping the burial of former Prime Minister Raila Odinga."
He further noted the petitioner's core argument that the wishes of the late Raila weren't respected and allegedly upheld.
The court's decision means that the burial on Raila Odinga will now likely proceed as originally planned.
Current indications suggest the ceremony is scheduled for Sunday at his home in Siaya County.
This directive, effective immediately, clears a major legal hurdle for the funeral committee, allowing them to continue with the preparations for the state burial of the celebrated statesman.
